A. When used in
this Code, unless otherwise expressly stated or unless the context or subject matter
otherwise requires, the following terms shall have the meanings indicated:
ASSESSOR or VILLAGE ASSESSOR
-- The Assessor of the Village of New York Mills, New York.
BOARD OF APPEALS --
The Board of Appeals of the Village of New York Mills, New York appointed in
accordance with the provisions of Chapter 200, Zoning, of this Code.
BOARD OF TRUSTEES, VILLAGE BOARD or BOARD -- The Board of Trustees of the Village of
New York Mills, New York.
BUILDING INSPECTOR --
The Code Enforcement Officer of the Village of New York Mills, New York while
serving as the enforcement officer of the subdivision regulations of this
Village.
CODE -- Unless
otherwise specifically qualified means the Village of New York Mills Municipal
Code.
CODE ENFORCEMENT OFFICER
-- The enforcement officer appointed pursuant to Article II of Chapter
70, Building Construction, of this Code to enforce Chapters 70, Building
Construction, and Chapter 30, Zoning, as well as Chapter 52, Air Pollution, and
the subdivision regulations adopted by the Planning Board of this Village and
such other and related duties as may be assigned to him by the Board of
Trustees.
COUNTY -- The County
of Oneida in the State of New York.
COUNTY CLERK -- The
County Clerk of the County of Oneida in the State of New York.
FIRE CHIEF or CHIEF OF THE FIRE DEPARTMENT -- The Fire Chief of the Village of New York
Mills, New York.
HEALTH OFFICER -- The
Health Officer of the Village of New York Mills, New York.
MAYOR -- The Mayor of
the Village of New York Mills, New York.
MUNICIPAL CODE -- The
Village of New York Mills Municipal Code.
OWNER -- A person who
has the legal title, alone or with others, or exercises dominion or control
over property, both real and personal.
PERSON -- One or more
persons of either sex, natural person, corporations, partnerships,
associations, joint-stock companies, societies and all other entities capable
of being sued.
POLICE CHIEF or CHIEF OF POLICE -- The Police Chief of the Village of New
York Mills, New York.
REGISTRAR OF VITAL STATISTICS -- The Registrar of Vital Statistics of the
Village of New York Mills, New York.
SEALER OF WEIGHTS AND MEASURES -- The Sealer of Weights and Measures of the
County of Oneida in the State of New York.
SUPERINTENDENT OF STREETS or STREET SUPERINTENDENT -- The Superintendent of Streets in the
Village of New York Mills, New York.
TRUSTEE -- A Trustee
of the Village of New York Mills, New York.
VILLAGE -- The
Village of New York Mills, New York.
VILLAGE ATTORNEY or ATTORNEY
-- The Village Attorney of the Village of New York Mills, New York.
VILLAGE BOARD -- The
Board of Trustees of the Village of New York Mills, New York.
VILLAGE CLERK or CLERK
-- The Village Clerk of the Village of New York Mills, New York.
VILLAGE ENGINEER --
The engineer or engineering firm retained by the Village of New York Mills, New
York to serve in the capacity of engineer or consulting engineer to this
Village.
VILLAGE JUSTICE or POLICE JUSTICE -- The Village Justice of the Village of New
York Mills, New York.
VILLAGE TREASURER --
The Village Treasurer of the Village of New York Mills, New York.
ZONING OFFICER -- The
Code Enforcement Officer while serving as the Enforcement Officer of Chapter
200, entitled "Zoning," of this Municipal Code.
B. All other
words used in this Code and not otherwise specifically defined shall be
construed in the manner that they are normally used unless the context or
subject matter requires otherwise; but words that have acquired a technical
meaning in law and are so used shall be construed and understood in accordance
with such meaning.
§ 1-15. General
penalty.
A. When no
specific penalty is prescribed in any ordinance contained in this Code, or in any
other provision of law, for any act which is prohibited or for the failure to
do any act which is required and is made or declared to be unlawful, the
violation of any such provision shall be punished by a fine not exceeding $250.
B. In all cases
the Board of Trustees may enforce obedience of any provisions of this Code by
injunction.
